This Privacy Policy for www.goodlandtx.com (the “Website”) for that certain real property called Goodland, located in Goodland, Texas (the “Community”) owned by Prairie Ridge Partners, LP, a Limited Partnership company, and developed by Provident Realty Advisors. Inc, a Texas Corporation company (collectively, “we”, “our” or “us”) explains our commitment to respecting the privacy rights of visitors to the Website and any of our subdomains or social media accounts for the Community (collectively, together with the Website, the “Sites”). The use of the terms “user,” “you,” “your,” “customer,” or “consumer” refers to you, a user of this Website, the other Sites, patron of our services, and others who may interact with us. We have adopted the policies outlined in this Privacy Policy, which serve as the basis for our use of your personal information in our business and advertiser relationships. This Privacy Policy is intended to comply with privacy laws applicable to the Community, us and our companies, and the operation of the Sites. This Privacy Policy, however, does not cover our, or our affiliated companies’, offline privacy practices for personal information you may provide to us through means other than through our Sites. By using the Website, other Sites or providing Personal Information, hereinafter defined, to us in other ways, you agree you have read and agree to the terms of this Privacy Policy.

We will not sell, share, or rent this information to others in ways other than those outlined in this Privacy Policy. The Community collects information from our users at several different points on the Website. Personal Information (defined below) provided by users (“you”) will be used by the Community to improve the Website and provide a more personalized experience for the user, but information which identifies a specific individual will not be disclosed to others without the user’s permission unless necessary to provide services which the user has requested.

Generally, this information is requested when you contact us for information or subscribe to our email list.

Our Website supports mobile access or mobile applications. As such, it may gather location-based data from mobile devices. Our website also uses cookies/web beacons to identify users when they surf onto the Site as well as to track relevant data about the user. Web Beacons. Web beacons are very small, invisible graphics present on web pages or emails that help us track when the page or email has been accessed. Some parts of the Sites, emails, and other files may use web beacons, also known as clear gif technology or action tags. We do not use web beacons to collect, use or store any Personal Information about you.
Customer Service. Based upon the personally identifiable information you provide us we may send you a confirmation e-mail to act as a receipt of your purchase. We will also communicate with you in response to your inquiries and to provide the services you request.

Business Services. We will also communicate with you in connection with services you request from The Community.

EU General Data Protection Regulation. For residents of the EU, please note that this Privacy Policy has been drafted in accordance with the requirements of the EU General Data Protection Regulation (GDPR).

California Online Privacy Protection Act Compliance. Because we value your privacy, we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. We therefore will not distribute your personal information to outside parties without your consent.

Disclosure of Collected Information.

  1. Information from the Application. The Community will never disclose to non-affiliated third parties without your prior approval your e-mail address, phone number, or other Personal Information that we collect via the Sites. However, we reserve the right to outsource certain activities to certain third parties. In such cases, we strictly limit the information provided to these third parties to the minimum necessary for them to perform the functions for which we have retained them and prohibit them from using the information for any other purpose or retaining it after it is no longer needed.
  2. Law Enforcement. The Community, however, will cooperate with official law enforcement inquiries, such as fraud investigations and subpoenas, and will disclose your information when necessary to comply with state and federal laws and regulations.
  3. Disclaimer. We cannot ensure that all of your private communications and other Personal Information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), we may be forced to disclose Personal Information to the government or third parties under certain circumstances, third parties may unlawfully intercept or access transmission or private communications, or users may abuse or misuse your Personal Information that they collect from the Sites.
  4. Children 18 Years of Age and Younger. You must be 18 or over to use the Sites. We are in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. Our Sites and services are all directed to people who are at least 13 years old or older.

Security. The Community is committed to ensuring that your information is protected while you are on the Sites. The Community uses appropriate and reasonable measures to maintain the security of your Personal Information. Disputes. This Privacy Policy shall be interpreted and governed by the laws of the United States and the State of Texas, without regard to conflicts of laws. Any dispute arising out of this Privacy Policy shall be settled by final and binding arbitration conducted in Dallas, Texas, by one neutral arbitrator knowledgeable in the subject matter covered by this Privacy Policy, in accordance with this Section and the then current Commercial Arbitration Rules of the American Arbitration Association (“AAA”). The successful party in the arbitration shall be awarded by the arbitrator that party’s costs and expenses, including attorneys’ fees and administrative fees of the AAA. An award may be confirmed and judgment entered in any court having competent jurisdiction. Except as otherwise provided for herein, any litigation initiated under such act or otherwise shall be conducted in a court of competent jurisdiction located in Dallas, Dallas County, Texas.

Additional Information.

  1. Notification of Privacy Policy Changes. We reserve the right to change this Privacy Policy at any time, and you may visit this page to learn of our revised Privacy Policy. All such changes shall be binding on you 14 calendar days after they are initially posted on the Website unless you are a new user, in which case they are binding on you immediately.
  2. Business Transition. In the event we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of our assets, your personally identifiable information will likely be among the assets transferred.
  3. Notices. Any notices or other communication required or permitted to be made or given by either Party pursuant to this Privacy Policy will be in writing, in English, and will be deemed to have been duly given when delivered if delivered to the address specified herein or such other address as The Community may specify in writing. You also represent that you are not engaging in activities in an attempt to reverse engineer the Sites, portions of the Sites, or any materials available through the Sites. You also represent that any information you provide is true and accurate.
  6. Customer Reference. You agree (i) that the Community may identify you as a recipient of services and use your logo in client lists, sales presentations, marketing materials and press releases, and (ii) to develop a customer profile for use by the Community on Community websites for promotional purposes.
